Benjamin J. Hammer has practiced law in the Flathead Valley since 2012 and is licensed in the courts of the State of Montana and the United States District Court for the District of Montana. His practice centers on employment law and HR compliance, business and real estate transactions, and estate planning, the day-to-day legal work of Montana employers, families, and closely held businesses.
On the employment side, Ben counsels both employers and employees on hiring and separation decisions, employment and independent contractor agreements, non-competition and confidentiality terms, handbooks, and workplace policies. He has drafted and implemented employment policies and procedures for public entities, nonprofits, and private employers across northwest Montana, and he advises management on the compliance questions that come up before a dispute does, classification, leave, accommodation, discipline, and documentation.
His transactional practice covers business formation and governance, mergers and acquisitions, lending and commercial real estate transactions, and contract drafting and review. Ben spent the first decade of his career in insurance defense and workers' compensation litigation, representing municipalities, contractors, timber and energy companies, and special districts, and he brings that litigator's eye to every agreement he drafts. The goal is a document that holds up if it is ever read by someone other than the parties who signed it.
In estate planning, Ben prepares wills, trusts, powers of attorney, and health care directives, with attention to asset protection and the orderly transfer of family land and closely held business interests. He also guides personal representatives and families through Montana probate from appointment through closing.
Ben earned his Juris Doctor from the Shepard Broad College of Law at Nova Southeastern University in 2012 and his Bachelor of Arts in History and Religion from Linfield College in McMinnville, Oregon. He has served since 2013 as a volunteer board director for Flathead Industries, which provides residential, employment, recreational, and medical support services to individuals with disabilities in the Flathead Valley and statewide. Since 2012 he has been a volunteer board director and coach for the Northwest Lacrosse Association, helping build a valley-wide league that now serves more than 200 youth players.
