Montana Wrongful Death Law

Compassion and resolve in your family's darkest hour.

Losing a loved one to someone else's negligence is devastating beyond measure. Amid grief, families face urgent practical concerns — funeral expenses, lost income, medical bills from final treatment, and the long-term financial impact of losing a provider, partner, or parent.

Montana's wrongful death statute allows certain family members to pursue a civil claim against the party whose negligence, recklessness, or intentional act caused the death. These claims seek both economic damages and compensation for the profound personal loss the family has suffered.

At Cannon Breck, we approach wrongful death cases with the sensitivity they demand and the legal tenacity they require. We handle every aspect of the claim so families can grieve without the added burden of legal complexity. Our goal is to secure accountability and meaningful compensation that provides lasting security.

The Cannon Breck Difference

Local roots. Proven results. Personal attention.

Too many firms treat personal injury as volume work — sign clients, settle fast, move on. That approach leaves money and justice on the table. At Cannon Breck, we limit our caseload because your case deserves an attorney who knows your name, understands your injuries, and fights like your future depends on it — because it does.

Rooted in the Flathead Valley, we know the judges, the courtrooms, and the community. That local knowledge translates to smarter strategy, better outcomes, and a legal experience that feels personal from the very first conversation.

Frequently Asked

Questions we hear most.

Injuries raise urgent questions. Here are answers to the concerns our clients bring to their first consultation.

Who can file a wrongful death claim in Montana?
Under Montana Code Annotated 27-1-513, the personal representative of the deceased person's estate files the wrongful death claim on behalf of eligible heirs. Heirs typically include the surviving spouse, children, and in some cases, parents or other dependents. The court appoints a personal representative if one hasn't been designated.
What damages are available in a Montana wrongful death case?
Montana wrongful death damages include loss of financial support, loss of companionship and consortium, funeral and burial expenses, medical bills from the final injury or illness, pain and suffering the deceased experienced before death, and loss of inheritance. Economic experts help quantify the lifetime financial impact.
How long do I have to file a wrongful death claim?
Montana's statute of limitations for wrongful death is generally three years from the date of death. However, the discovery rule may extend this deadline in cases where the cause of death wasn't immediately apparent. Claims against government entities have shorter notice requirements.
Can I file a wrongful death claim if there's a criminal case?
Yes. Criminal prosecution and civil wrongful death claims are separate proceedings with different standards of proof. You can pursue a wrongful death claim regardless of whether criminal charges are filed, and even if the defendant is acquitted in criminal court. The civil standard — preponderance of evidence — is lower than the criminal standard.
How is compensation distributed among family members?
The personal representative collects the full amount of damages, which is then distributed among the heirs according to Montana law. Distribution typically considers each heir's relationship to the deceased and the degree of dependency and loss suffered by each family member.
What if my loved one was partially at fault?
Montana's comparative negligence rules apply to wrongful death claims. The family can still recover damages as long as the deceased's fault doesn't exceed 50 percent. Compensation is reduced by the deceased's percentage of responsibility.
